§ 1 Introduction
This Privacy Policy contains information concerning the processing by the Marketing Communication Association SAR, ul. Czerska 8/10, 00-732 Warsaw (hereinafter: "SAR") of personal data of persons using the website https://www.imaginationday.pl/ hereinafter: "Users" and "Site").
§ 2 Processing of personal data
In view of the entry into force of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC (hereinafter: "RODO") (OJ EU L of 4 May 2016), on the basis of Article 13 RODO, SAR provides Users with the following data protection information:
I Administrator:
The administrator of the Users' personal data is Stowarzyszenie Komunikacji Marketingowej SAR with its registered office in Warsaw (00-732) at ul. Czerska 8/10, entered into the register of entrepreneurs and the register of associations, other social and professional organisations, foundations and independent public health care establishments - kept by the District Court for the Capital City of Warsaw in Warsaw, 13th Commercial Division of the National Court Register under number 0000177032.
II Purposes, categories of personal data and grounds for processing:
SAR processes Users' personal data on the basis of its legitimate interest (Article 6(1)(f) RODO), which states:
management of the Site,
ensuring the security of the Site and Users,
conducting statistical analyses,
to comply with legal obligations under the RODO in terms of exercising rights and therefore archiving requests made to the SAR or informing about privacy risks,
the dissemination of information of an informative and marketing nature, including for the purpose of informing users about projects, workshops, training courses, conferences and other events carried out by the SAR.
In addition, once Users have given their consent (i.e. unchecked the relevant checkbox), SAR will process Users' personal data on the basis of Article 6(1)(a) RODO in order to process registration for the Imagination Day 2023 conference via the contact form, to send notifications, information and materials about the event and to enable participation in the event.The following personal data of users will be processed: first name, surname, contact telephone if applicable, e-mail address, place of employment (company name, department), position, data identifying the computer, tablet or mobile phone, IP number, location.Decisions regarding the personal data processed are not taken by automated means and personal data is not subject to profiling.
III Security of personal data:
In order to secure Users' personal data, SAR has implemented technical and organisational safeguards to protect it from deletion, loss, publication, modification, deterioration, unlawful dissemination and misuse, whether this could occur by accident or as a result of deliberate or illegal actions.
IV Co-administration and recipients of personal data:
Personal data may be transferred by the SAR to public or private entities if such an obligation arises from generally applicable legislation. SAR transfers personal data to TRAKIDO As part of its activities, SAR entrusts the processing of personal data to third parties who process it on its behalf and do not use it for their own purposes. These entities come from European Union member states or from other countries that sufficiently protect personal data. Data may be transferred outside the European Economic Area.
V Data retention period:
There is no uniform time limit for processing personal data. SAR will process personal data for the following length of time:
to analyse activity on the Site and conduct statistical analyses - until it is no longer of use to the SAR,
management of the Site - until such time as the data is no longer useful,
to ensure the security of the Site and Users - until such time as the data is no longer useful,
to comply with legal obligations under the RODO for the exercise of rights and therefore to archive requests made to the SAR or to inform Users of threats to their privacy - until the expiry of the limitation periods,
for marketing purposes, until the data is no longer relevant or you object to the processing of your personal data,
fulfilment of the application (online registration) for the Polzak Marketing 2021 conference - until the event is realised and the related settlements are closed, until the expiry of the statute of limitations for claims or until the withdrawal of consent, which may take place at any time in person at the registered office of SAR, by post or by email to: rodo@sar.org.pl, whereby withdrawal of consent does not affect the lawfulness of the processing of personal data carried out on the basis of consent prior to its withdrawal.
VI Rights in relation to the processing of personal data
Users are entitled to:
The right to access your data and a copy of your data.
The right to rectification (rectification of your data).
The right to erasure - if they believe that SAR has no right to process the data.
Right to restrict processing - they can request that the processing of their personal data be restricted to storage if they believe the data is inaccurate or the processing is unlawful, and they do not want SAR to delete the data because they need it to investigate, establish or defend a claim, or for as long as the objection is considered legitimate.
Right to object - they can object to the processing of their personal data if the legal basis for the processing is the legitimate interest of the controller. The request should state the reasons for the objection by specifying what constitutes the particular situation in respect of which the objection is made. An objection will not be taken into account if SAR demonstrates that its legitimate interest overrides the User's claim or that its data is needed by SAR to establish, assert or defend claims against the User.
Right to data portability - The right to data portability applies to data that has been provided to SAR on the basis of consent or contract. This can be received in a structured format (e.g. xml) or it can be sent directly to the designated data controller.
Right to lodge a complaint - if you consider that your personal data is being processed unlawfully, you can lodge a complaint with the President of the Data Protection Authority or any other supervisory authority.
Where data is processed by SAR on the basis of consent, consent is voluntary but necessary for the purpose in question. Consent can be withdrawn at any time, which will result in SAR ceasing to process the data, if there is no other legal basis giving this possibility. The withdrawal of consent does not affect the lawfulness of the processing prior to its withdrawal.
A request related to the above-mentioned entitlements can be made in person at the SAR's office, by post or by email to: rodo@sar.org.pl. If you apply in person at the SAR headquarters, you can use a ready-made form available at the reception desk. Applications shall be processed without undue delay and at the latest within one month of receipt by the SAR. If necessary, this deadline may be extended by a further two months due to the complexity of the request or the number of requests. Within one month of receipt of the request by the SAR, the SAR shall inform the data subject of the extension and the reasons for the delay.
§ 3 Cookies
By starting to use the website on the domain https://www.imaginationday.pl/ the User accepts by activating the "Accept" button that the website places IT data (cookies) on the User's terminal device (e.g. computer, laptop, smartphone, tablet), which are files that enable, among other things, the recognition of the device, the preservation of browsing settings and preferences and the compilation of statistics (e.g. to count the number of hits on the Website).
